James C. Macdonald represents and counsels public and private businesses on a wide range of environmental, construction, real estate and business law issues. Mr. Macdonald’s primary practice focus is representing clients in:

  • defense and prosecution of environmental cost recovery suits,
  • environmental compliance counseling, and
  • construction defect, delay and cost overrun litigation. 

He has represented clients in CERCLA, RCRA, CWA, CAA, HSAA and Proposition 65 and common law claims filed in both state and federal court. The cases he has worked on include major soil and groundwater contamination cases, large class action toxic exposure matters and product cases involving toxic components. Mr. Macdonald has also work on numerous residential and commercial construction defect, delay and cost overrun cases involving soil subsidence and the degradation of building materials exposed to toxic components.

Mr. Macdonald’s experience in the field began as an environmental engineer in Rochester, New York after graduating in 1986 with a B.S. degree in Geomechanical Engineering from the University of Rochester. In 1989, he began working as an environmental engineer for Harding Lawson Associates, a national environmental consulting firm. His extensive private section environmental consulting work included interpreting environmental regulations for clients’ air and water quality compliance, project management, preparation of feasibility studies and remedial action plans, designing and creating specifications for groundwater and soil remediation systems, installation of monitoring wells, implementation of soil-gas investigation and UST management programs and designing water supply and sanitary sewer management systems.

Mr. Macdonald regularly employs various legal methods to successfully resolve the firm’s clients’ claims as quickly and economically as possible.  These include the following: 

  • Obtaining the dismissal of a multi-million dollar CERCLA claim through summary judgment by demonstrating that the client’s wastes were not CERCLA hazardous substances
  • Obtaining a multi-million dollar settlement for the firm’s developer client by demonstrating an existing corporation was the successor-in-interest to the contamination liabilities caused by its predecessor corporation
  • Obtaining complete recovery for past and future costs of investigation, remediation and attorneys’ fees for the firm’s property owner client by demonstrating that former tenants were jointly and severally liable under the property lease and RCRA

Mr. Macdonald received his J. D. Degree from Western State University College of Law, where he was a member of the law review and graduated sixth in his class.

Mr. Macdonald was formerly a senior associate with Sedgwick, Detert, Moran & Arnold. Mr. Macdonald also previously worked as a senior associate at Wood, Smith, Henning & Berman, and an associate with Anderson, McPharlin & Connors in Los Angeles, California.

Mr. Macdonald has been awarded the "AV" rating by the Martindale Hubbell Legal Directory, and his firm Bois & Macdonald has been awarded the “Preeminent” rating by Martindale Hubbell.
